WIN A TRIP TO MANCHESTER
In Santiago, on February 20th, 2018, VIÑA CONCHA Y TORO LIMITADA, (from this point on, the “Organizer”) identified with unique tax role N ° 90.227.000-0 represented by its Corporate Marketing Manager Mr. Cristobal Goycoolea, who acts as the legal representative of both Concha y Toro Limitada and CASILLERO DEL DIABLO, all domiciled on the address Nueva Tajamar Ave. 481 Torre Norte, 15th floor, Las Condes district, Metropolitan Region, in order to establish the following Promotion Bases:
First. Viña Concha y Toro S.A. (Concha y Toro) is a company which commercial purpose is the production and distribution of wines, which includes those made under the brand Casillero del Diablo (the “Brand”).
Second. Concha y Toro will carry out a promotional campaign called “CASILLERO DEL DIABLO: WIN A TRIP TO MANCHESTER” focused on increasing the awareness of the brand. Such promotion is part of a global scale campaign where several particular activities will be included for the sale points located in Chile, Uruguay, South Korea Australia, China and Japan.
In compliance with the provisions of article 36 of Act No. 19.496 on Consumer Rights, these Promotional campaign Rules, contain the description of the mechanics, prizes and time frames in which those can be claimed and the channels of notification of the results of the draw.
For the said promotional campaign (from this point on the “promotion”) individual who are of legal age according to their domestic law and who comply with all the established requisites set forth in the basis and conditions (the “participants”).
THIRD: Promotion period.
The present promotional campaign will go into effect from March the 1st until April the 22nd, 2018, inclusive, at exactly 23:59 as the maximum date to participate on the website (the “promotion period”). Despite the above, for Chile, the promotional period will conclude on April the 30th at 23:59, while in China, the period will conclude on April the 15th at 23:59, in all of the above these periods refer to the local time zone of each country.
FOURTH: Promotion mechanics
The promotional campaign “CASILLERO DEL DIABLO WIN A TRIP TO MANCHESTER” consists of the following:
a) The participants must register the requested information in a mini of the website http://www.casilleromanchester.com. The winners will be elected by a draft which will take place in front of a notary public. On the website https://www.easypromosapp.com/sorteo-de-un-listado/
b) The campaign will be spread through various digital and traditional media, supported by POP material distributed in collars, stoppers shelf talkers, bottle nickers, among others delivered as each Distributor deems appropriate.
c) The spreading of this promotional campaign will take place in the sales points associated and determined by the different distributors at a global scale and will be spread using POP material and massive means of communication as well as the social networks previously determined by Concha y Toro.
The prizes associated with the present promotion, are destined to the campaigns in all the countries abovementioned. These consist, as described below, on a trip to Manchester and in addition, in some countries there will be different mechanics to opt for secondary prizes. Also, will be drafted, among all the participants who have shared their registration on a global scale, 2 autographed shirts of the 2017 – 2018 season.
The participants who comply with all the requisites established in this bases and conditions and in accordance with all the established procedures, could obtain one of the following prizes (each one and in whole named as “the prizes”) of the promotion “CASILLERO DEL DIABLO WIN A TRIP TO MANCHESTER”.
• One of the 26 trips to Manchester, England. The winners will be able to participate in a soccer match with the Manchester United in Old Trafford Stadium. This prize includes, round airplane tickets in economy class on a designated airline, stay in the city of Manchester for 3 days and 2 nights in a 5-star hotel, all main meals included, transportation to different city locations during these days, equipment to play at Old Trafford (except for soccer shoes) plus the experience of live the dream of playing in the Theater of Dreams. The trip considers departure on Monday, May 21sh, 2018 and return on Thursday, May 24th of the same month.
In order to play the match, on the day of the event, each one of the prize winners shall sign a document issued by Manchester united and Concha y Toro, where the winner clearly expresses consent and declares to be physically suitable to play, excluding of any sort of liability both Manchester United and Concha y Toro. Shall be stated that both Concha y Toro and Manchester United, shall not be liable in the occurrence of a delay or cancellation of the flight on the designated Airline either by departure or return dates. The date of the event is unmovable, and the match cannot be rescheduled, which will require the purchase of new air tickets for a different activity.
¥ According to availability and place of departure, the trip considers departure by Monday, May 21st, 2018 and return on Thursday 24th of the same month.
¥ Based on availability it is possible to meet 2 legends of Manchester United (former players).
¥ Secondary prices defined by the distributors of each market, according to their strategies and availability.

China: 6 winners
Global: 4 winners
SIXTH: Campaign management and delivery conditions.
Concha y Toro will ensure the realization of the prize draw of all the prizes described above, based on the number of registered participants on the mini website www.casilleromanchester.com, In addition, Concha y Toro shall be responsible for the recordkeeping and maintenance of the corresponding database and shall make the delivery of prizes to the promotion winners.
The marketing and spreading of the campaign will be valid from March 1st, 2018 to April 22nd, 2018 on a global scale, with the exceptions of Chile and China as described in clause 3 above.
Each market, throughout the distribution team of Concha y Toro, will be responsible for delivering and coordinating the trips of the respective winners.
It is an indispensable condition for receiving the prize that the winner grants his / her consent for, in compliance with the respective laws, his / her identity can be disclosed and for his / her voice, recorded images and / or the photographs taken, can be displayed by any means of communication, if CONCHA Y TORO, with its brand CASILLERO DEL DIABLO decide to do so. Given the abovementioned, no rights of exclusivity, nor rights for exhibition, nor the delivery of all personal personal data requested for registration in the website www.casilleromanchester.com shall be claimed.
Once the winner is contacted, and upon checking their personal information with the information delivered, Shall be a mandatory and unmodifiable condition, that each contacted winner shows their identity card, being of legal age and capacity according the domestic legislation.
Winners commit to give publicity testimonies. In this context, in conformity with the respective legislation, winners confer their express consent in favor of Concha y Toro to use the testimonies, including but not limited to, reproduction of images, name, country of residence and identification card of the winner on any means of communication regardless of any geographical limitation and without any right to compensation, during the period of the promotion and up to 36 months after the conclusion of such term. No rights of exclusivity, nor rights for exhibition, nor the delivery of all personal data requested for registration in the website www.casilleromanchester.com shall be claimed.
Participants acknowledge and accept that Concha y Toro and Manchester United in their parent companies, branches, and related companies, in accordance to the local legislation, can make use of the personal date disclosed by participants in virtue of their participation in the promotional campaign, on bank registries or own data. Participants exonerate of any liability both Manchester United and Concha y Toro for any misuse of such data by third parties. Neither Manchester United nor Concha y Toro will commercialize or assign such data without express authorization of the participants, according to the governing law.
including but not limited to the reproduction of images, names, country of residence and identity card of the winner, an authorization that the participants in the Promotion grant to CASILLERO DEL DIABLO, in full compliance with the provisions of Law 19.628 on Protection of Private life and personal data.
The virtual prize draw will be held digitally on the dates:
Wednesday, May 2nd, 2018 in Chile.
Monday, April 23rd, 2018, globally except for Chile and China.
Thursday, April 19th, 2018 in China
SEVENTH: Delivery Management.
CONCHA Y TORO, via the agency DAF, will contact the potential winners to coordinate the delivery of the drawn prizes.
The potential winner shall present his/her identity card, in each market, to the marketing team of the distributor of Concha y Toro, to certify his/her conditions as a winner, where CASILLERO DEL DIABLO will not be liable to the winner and / or third parties in the event that the prize is collected by a person who proves their identity with a false or adulterated document, not having the winner and / or third party any right to claim compensation and / or damages whatsoever from Concha y Toro for the occurrence on the above.
It is expressly established that the prize is personal and non-transferrable and given so it is not redeemable in products, money or other goods. It is established that the prize can be awarded to another person, defined by the winner, in case he/she is unable to make the trip. The said person must be of legal age and capacity under the domestic law. For this the winner shall have 2 days to communicate the name of this person, in the event that the above does not occur, Concha y Toro, with all the authority, can choose another winner.
Once the draw has been made, Concha y Toro has 3 business days to wait for a response and / or contact with the winner. In case that such contact and corroboration with the winner could not be established, Concha y Toro has the power to make another draw for the delivery of the corresponding prize.
EIGHTH: Taxes and transportation costs
Any tax which has to be collected or that will further be creates, with regard of the prizes, and the expenses in which potential winners incur for their assignation, use, transportation, retirement or stay will be in charge of every potential winner, as well as any other additional expense not covered by the prize, by which the potential winner has to incur in relation with the prize or to make use of such prize.
NINTH: prize warranty and participation
Neither Concha y Toro nor Manchester United shall be liable for any damages that potential winners might suffer, either physical or to their assets and goods, upon their participation in the promotional campaign, or with regard to the withdraw from or use of the prizes. In addition to the above, neither Concha y Toro, nor Manchester United will give any type of warranty of quality, eviction, functioning, nor any other, in relation with the prizes, being necessary to address any claim to the manufacturers, importers or service providers of such services.
TENTH: Participation and Acceptance.
Are allowed to participate in this promotion, men, and women of 18 years old and older.
Participation in this promotion implies for all legal purposes, the total acceptance of these Promotion Terms, waiving any claim or legal action of any nature against Concha y Toro., And / or AGENCIA Daf.
It is declared here that it is expressly prohibited, and given such, cannot participate in this promotion, nor have access to claim the prizes, any worker of VTC Chile and Viña Concha y Toro, as well as workers of any of the other companies that ,directly or indirectly participate in the organization, implementation and /or events of this promotional campaign; by means of mere reference, workers of DAF marketing agency, responsible for the support of the implementation of this promotion.
This prohibition is also extensive to the spouses and relatives up to a second blood line, inclusive.
Concha y Toro and the agency DAF shall not be liable in the event that, as a consequence of any action, accident, or circumstance, by means of the prize, any damages bodily or economical, whether to the winner or to others. It is understood that the acceptance of a prize by any participant winner shall imply for all the legal effects, a waiver to any claim or legal action against Concha y Toro.
TWELFTH: Modification of the terms and conditions.
When unforeseeable circumstances justify so, Concha y Toro is entitled to suspend, modify, or cancel the promotion, without participants having any right to raise any claim.
THIRTEENTH: Acceptance to the terms and conditions
Participation of this promotion implies the acknowledgment and acceptance of these bases and conditions, as well as to the decisions adopted by Concha y Toro or Manchester United on any relevant situation not covered in such, given that the abovementioned are in full accordance to the current legislation and have been duly approved by the correspondent authority in the country.
FOURTEENTH: Legislation and applicable jurisdiction.
The promotional campaign (promotion) will be ruled by the laws of the Republic of Chile, in the event of any controversy originated from the present promotion, shall be ruled by the jurisdiction of the commercial courts of the city of Santiago.
FIFTEENTH: Notarized bases.
In case of any doubt, such shall be determined upon these governing bases, which will be notarized in a Notary Public to be defined by the ORGANIZER.
The holder of a signed copy of these bases is authorized to request and sign their notarization before a Notary Public, together with the other elements corresponding to this promotion.
